In September 2013, immediately after the murder of Pavlos Fyssas, the Greek Police arrested the leadership of Golden Dawn, as well as tens of its party officials and members, who were involved in the criminal activities included in the huge case file. After a long inquest which lasted 9 months, the Court of Appeal decided with irrevocable decree that 69 individuals, including all of Golden Dawn’s Parliamentary Group from the 2012 elections, will stand trial charged with participation in a criminal organisation. Described in the 1109 pages of the decree are all of the crimes committed by Golden Dawn party officials and members since 2008.

On 20th April 2015 one of the most important trials in contemporary Greek history will begin. It is set to be a huge process that is expected to last several months. The victims and their relatives will join the proceedings as a civil party in three cases, the case of the murder of Pavlos Fyssas, the case of attempted murder and attacks on Egyptian fishermen, as well as the case of attempted murder against the trade unionists from PAME (Trade Union Front). We believe that this trial concerns all of us, because the outcome will be a milestone as much in local politics as in Greek society. Golden Dawn themselves are trying to establish a regime of fear and to keep their actions secret. Until now, whenever its members of parliament, party officials or members has been involved in trials, the organisation has used terror tactics both inside and outside of the courtroom and tried to establish a regime of fear.

Due to the huge significance of this trial, we consider it our obligation to monitor it closely and our duty to overcome fear.

Οι συνήγοροι της πολιτικής αγωγής πήραν το λόγο και ο καθένας ανέπτυξε τα επιχειρήματά του, ενώ το κλίμα εκτραχύνθηκε πάλι όταν ο συνήγορος Καπερνάρος κάλεσε τον συνήγορο Τζέλη να κάνει λιγότερο θέατρο, ακριβώς τη στιγμή που αναφερόταν στους επικείμενους κινδύνους, τις μεθοδεύσεις και τα προβλήματα σαν αυτό που συνέβη στην προηγούμενη δικάσιμο.

Την πορεία του προς την έδρα προκειμένου να καταθέσει εγγράφως τα όσα μόλις είχε αναγνώσει (για την ορθή καταχώρηση στα πρακτικά), ανέκοψαν οι συνήγοροι του Ν.Μιχαλολιάκου οι οποίοι ζήτησαν δεκάλεπτη διακοπή της δίκης προκειμένου να διασκεφθούν οι συνήγοροι.

Day 10: DECIDING THE MATTER OF CIVIL ACTION; THE DEFENSE OBJECTS

Rejecting requests from the counsel for the civil action, the court ruled against allowing the Golden Dawn trial to be filmed. The court also heard objections from the defence counsel for the Golden Dawn leader that the trial was invalid due to the alleged interference of the then government in the judicial system after the Fyssas murder

Η κα Ζαφειρίου συνέχισε χαρακτηρίζοντας τη Χρυσή Αυγή απεχθές μόρφωμα της ιστορίας. Προκλήθηκε ένταση στην αίθουσα. «Δεν είστε στα μικρόφωνα του ΚΚΕ» διέκοψε ο κ. Μιχαλόλιας. Ο συνήγορος του πατέρα του Π. Φύσσα Ανδ. Τζέλης απάντησε «εμείς δεν σας διακόψαμε» για να ανταπαντήσει ο κ. Μιχαλόλιας «εμείς δε μιλήσαμε για τον Στάλιν και το ΚΚΕ. Όταν φτύνετε θα σας διακόπτουμε».

ΗΜΕΡΑ 7: Ο ΑΓΩΝΑΣ ΓΙΑ ΤΗΝ ΠΑΡΑΣΤΑΣΗ ΠΟΛΙΤΙΚΗΣ ΑΓΩΓΗΣ

Η δίκη διακόπηκε και θα συνεχιστεί την Πέμπτη 25/6/2015 στις 09.00 στην ίδια αίθουσα, όπου θα λάβουν χώρα οι τοποθετήσεις των υπολοίπων συνηγόρων της πολιτικής αγωγής και των συνηγόρων υπεράσπισης επί της σημερινής πρότασης της εισαγγελέα, για να ακολουθήσει η οριστική επί του θέματος κρίση από το δικαστήριο.

DAY 6: THE PUBLIC PROSECUTOR’S PROPOSAL

The court was adjourned at 13:40 and will pick up on Monday 22.6.2015 at 9:00 in the same hall. The individuals declaring themselves civil plaintiffs and counsel for the defense will each voice their stance on the Prosecutor’s proposal. Following this, the President and other members of the tribunal will settle on a final decision on the matter.

Day 5: Objections of the Defence

P. Michalolias (photo), counsel and brother to N. Michaloliakos, added that in the particular case referent to art. 18, there is no legitimate reason to involve civil parties given no damaged person/good has been specified, nor can damage to society more broadly be argued, as otherwise it would be an issue of “popular civil action”. The following speakers voiced their agreement with Mr. Michalolias’s position.

Furthermore, all of the above declared their attendance as civil parties in the prosecution of all those accused of membership, participation and leadership of the criminal organization, “People’s Association – Golden Dawn”

Day 2: THE REPETITION

It was eventually agreed that the legal recognition of Civil Action would be determined in subsequent hearings.
