Court access<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Hearings continue to be accessible to members of the public, provided they present their identity cards at the entrance. The courtroom was packed. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>2. Presence and representation of the defendants<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Nine (9) defendants were present at the beginning of the hearing. Thirteen (13) defendants were listed as absent; the remaining defendants were represented by their counsel. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>3. Giorgos Rotas\u2019 testimony (continued): cross-examination by the defence the civil action<\/b><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Before the defence began to cross-examine the witness, Andreas Tzelis (counsel for the Fyssas family) asked the court\u2019s permission to display a printed Google map of the area around Koralli cafe. There was some commotion in the courtroom as counsels stood to get a better look. Takis Zotos (counsel for the Egyptian fishermen) seized the opportunity to announce that, given that the issue has surfaced over and over again, he will likely repeat his request for audiovisual equipment to be provided throughout the trial. His request was entered on the record and the cross-examination of the witness began. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Andreas Tzelis:<\/b> To which area were you assigned during the week of 17\u201318 September? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Giorgos Rotas:<\/b> I don\u2019t remember; I\u2019ll have to check. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What code did you communicate with?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> 410-1.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did you all have walkie-talkies?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Tzouvaras and I did. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Was everyone in communication with the police station? Were all the bikes large? Did they have sirens or flashing lights?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> They come in different sizes. Not all of them have flashing lights but the ones we had that night did. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What was your immediate assessment of the situation? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> It seemed serious to me. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> How do you choose your route? On that night, why didn\u2019t you choose to drive through Salaminos avenue?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> That\u2019s up to the driver. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were the officers from the Keratsini unit also on large bikes?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Where did you meet the other unit?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> On Tsaldari street. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did you speak?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No, we just followed the flashing lights. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> You drove towards Koralli. Where were the Golden Dawners?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> They were all along the entire length of Pavlou Mela street. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were the four bikes driving down the street in parallel?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No, one after the other. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were the flashing lights on?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Presiding judge:<\/b> He has already told you. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> I want you to tell us where exactly you stopped your bikes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I don\u2019t remember exactly. From what I can remember, we left Koliousis to guard them.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did you know your Keratsini colleagues?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I had worked with some of them before, so I knew them a little. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Where did you go next?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> We were in the middle of Kefallinias street right before we started running.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Where was Hatzistamatis [the middleman]? On the Golden Dawners\u2019 side?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were cars driving past?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I can\u2019t remember. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were the bikes all parked together or one behind the other?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I can\u2019t remember. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did a policeman speak with the Golden Dawners?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Why not?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Why would we? Was I supposed to try and reason with 50 people holding beams? Eight people can\u2019t take on 50. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b><\/span><i> <\/i><span class=\"s1\">Were the Golden Dawners obstructing traffic?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> So they were obstructing traffic and holding beams? Wasn\u2019t that enough reason for you to intervene?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I informed the station instead. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did you ask Hatzistamatis for ID when he introduced himself as a colleague?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I don\u2019t know; Tsolakidis spoke to him. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What did Hatzistamatis say to you?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I heard him say there was a fight breaking out between the Golden Dawners and some people from the \u201cknown space\u201d. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What is the \u201cknown space\u201d? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Anarchists. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What were the Golden Dawners shouting? Did you hear?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> There were a screaming mob. They said, \u201cwhat are you doing here?\u201d, \u201cwhat are you looking at?\u201d. Wherever the police shows up, people who don\u2019t like the police show up as well. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> What did you do when they started to run?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> We followed them on foot. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Why didn\u2019t you take the bikes?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> It wouldn\u2019t have been practical. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> When you followed the mob and got to Tsaldari St, what did you see?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I couldn\u2019t really figure out who had gone where. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Which policeman was in the lead? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Legatou, I think. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> How did the mob leave? In formation?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> They all ran together as a team. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Why did it look to you like they would snatch Roupakias from you? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Because there were many of them \u2013 many more than us. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Were you at the Hytirio theatre when Golden Dawners beat the police? I\u2019m just asking in case you were afraid because of that.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Why didn\u2019t the police arrest anyone after the station ordered you to bring them in?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I don\u2019t know. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Violetta Kougiatsou (counsel for the Fyssas family):<\/b> In your testimony, you said you heard something before the mob started running. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> It seemed to me that these people knew what they were doing; they knew why they were running. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Kougiatsou:<\/b> In your testimony, you said there were Golden Dawners, and there was a lot of shouting, but you couldn\u2019t figure out whether there was a physical fight going on. And you said that you decided to intervene only in the event of such a fight. But now you say that, either way, there were too many of them for you to intervene. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No, that\u2019s not what I said. The station gave us orders to leave. The station always gives out that order; we aren\u2019t units that intervene in mobs. But we stayed and arrested people. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Kougiatsou:<\/b> And why did you say that, as you were approaching the murder scene, that your colleague, Ms Legatou, said, \u201cno, not with knives\u201d?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Because it was all over the news every day. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Kougiatsou:<\/b> Why did you take your phone out when the conversation with Hatzistamatis was happening?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Because I didn\u2019t know the area and I wanted to be able to give the station the right information if something happened. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Chrysa Papadopoulou (counsel for the Fyssas family):<\/b> What kinds of police units intervene in mobs?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> The Delta [rapid response unit] and MAT, YAT and YMAT (riot police) units. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> How long did Roupakias and Fyssas fighting for?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> 10\u201315 seconds. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Then why didn\u2019t the autopsy find any signs of injury beyond a bruise?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Because he didn\u2019t take any hits, he must be very good [Roupakias]. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> You said you asked him why he hit Fyssas. He answered that Fyssas had hit one of his guys; but if the two had fought, as you say, why didn\u2019t he just say, \u201cI hit him because he hit me\u201d? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b>\u2026\u2026..<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> How long did it take for you to drag Pavlos away and arrest Roupakias?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> About a minute.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> It says here that the first ambulance was called by the Dias motorcycle unit at 00:04, so the murder must have happened at 00:03 and you must have got to the place at 23:57.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Were your orders from the station to leave?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> The orders were to observe from a distance. What I understood was that we should leave. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Was this order given after Tsolakidis informed the station that they had started to run?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> What do you mean when you say that the groups converged around a point?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> That they were moving towards that point; that they were almost there. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> From recordings of the Dias unit\u2019s communications, it seems that at 00:00:50, Tsolakidis communicated that there was an issue involving Golden Dawn.<i> <\/i>Why did you say that this involved Perama as well? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> It was a mistake. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Did you inform the station when you arrived at the scene?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> We didn\u2019t inform them because the line was busy when I tried<\/span><span class=\"s2\"><i>.<\/i><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Did the station know that there were eight people there?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Judge:<\/b> Where are you going with these questions? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> To the fact that the police station didn\u2019t know how many policemen were at the scene.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><i>The presiding judge did not allow the counsel to ask questions based on recordings of police communications and insisted that questions be limited to the specific charges. <\/i><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><i>Counsel Tzelis vociferously objected, but the judge stood firm. <\/i><\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> The station gave you orders to observe individuals who were running and to report back on their actions. How many of the Golden Dawners who were running did you actually arrest?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> None. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Where did the patrol car arrive from?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> From Salaminos avenue, heading towards Tsaldari St. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Papadopoulou:<\/b> Who found the knife?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> We showed the patrol policemen where it was. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Eleftheria Tompaztoglou (counsel for the Fyssas family):<\/b> When you saw these people casting threatening looks, did you consider going into Koralli to ask what was going on?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. But we didn\u2019t do it. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> Are there often incidents in the area involving Golden Dawners and anarchists?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Not as far as I know. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> Did they tell you which unit was leaving when they started to run?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Negative. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> When civilians asked you to run, did you realise something had happened? Did you realise there were two groups? Where were the 50 people?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> The groups dispersed. We got to the crossing of Kefallinis and Tsaldari and saw the incident at number 62. The others spread out into the side streets. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> When you got there, was it just the two of them? Or were there others whom you took to the side?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I, personally, didn\u2019t take anyone to the side. The others had already started running away. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> Has your experience taught you that Golden Dawn is dangerous?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Yes. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tompatzoglou:<\/b> Did you decide not to intervene because you couldn\u2019t take on 50 people or because you couldn\u2019t take on 50 Golden Dawners?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> Eight men can\u2019t take on 50. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Tzelis:<\/b> Did Tsolakidis know you were within earshot when he spoke to Hatzistamatis?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> You should ask him. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">***<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Takis Zotos (counsel for the Egyptian fishermen):<\/b> By the time you left Koralli, had you seen a group of anarchists?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> No. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Zotos:<\/b> Why did the 30\u201350 people you saw leave? Was there some external stimulus? Did someone threaten them or did they decide on it themselves?<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I didn\u2019t notice anything external. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Zotos:<\/b> In your experience, when 30\u201350 people start moving together, why do they do it? <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Rotas:<\/b> I\u2019d say they had arranged it among themselves. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\"><b>Zotos:<\/b> Did you see anything else before they started to move?
