Day 192: According to the Judge witnesses need to be protected from retaliation or intimidation tactics

192nd Hearing, Court of Appeals, October 24th, 2017

I. Access to the Court

The courtroom remains open to the public upon presentation of a state ID card, which is retained by court authorities for the duration of the session. There was limited attendance by the public, but significant presence of members of the press.

II. Presence and representation of the defendants

Present at the hearing was defendant Efstathios Boukouras.

ΙΙΙ. Proceedings

The hearing dealt with the court’s judgment concerning the matter of calling the protected witnesses to the witness stand. The presiding judge decided, against the state prosecutor’s proposal, to overrule the motion by the defense counsels. The presiding judge stressed that the witnesses must testify at this stage without being physically present, as during the preliminary stage, to protect them from retaliation or intimidation tactics, under article 9 of 2928/2001, but also to effect their full testimony.

The presiding judge adjourned for October 30th in Korydallos, where the courtroom is well equipped, amid protests from defense counsel Michalolias P. who said that there are matters that should be addressed.
